These General Terms and Conditions (GTC) apply to all deliveries from Ryan's Specialties GmbH & Co. KG
A consumer is any natural person who concludes a legal transaction for a purpose that can predominantly be attributed neither to his or her commercial nor to his or her independent professional activity.

Offer and steps to conclude the contract
The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to order. Errors excepted.
By clicking the "Buy Now" button, you place a binding order for the goods listed on the order list. The purchase contract is concluded when we accept your order by sending an order confirmation by email immediately after receiving your order.
Right of Withdrawal for Consumers
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods. To exercise your right of withdrawal, you must notify us:

by means of a clear statement (e.g. a letter sent by post, telephone call or e-mail) of your decision to withdraw from this contract. To meet the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
You can use the attached one, but it is not mandatory.
consequences of revocation
If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier. You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.
exclusion of the right of withdrawal
The right of withdrawal does not apply, unless the parties have agreed otherwise, to the following contracts: Contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, Contracts for the delivery of goods that can spoil quickly or whose expiry date would be quickly exceeded, Contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery, Contracts for the delivery of goods if, due to their nature, they were inseparably mixed with other goods after delivery, Contracts for the delivery of alcoholic beverages, the price of which was agreed upon conclusion of the contract, but which can only be delivered 30 days after conclusion of the contract at the earliest and whose current value depends on fluctuations in the market over which the entrepreneur has no influence, Contracts for the delivery of sound or video recordings or computer software in a sealed package if the seal was removed after delivery, Contracts for the delivery of newspapers, magazines or illustrated magazines with the exception of subscription contracts.
Prices, down payment and delivery reservation
The prices stated on the product pages include VAT and other price components.
For special orders, such as wallpaper and furniture, which are made or ordered from the manufacturer according to your wishes, a deposit of 30% is usually due upon order confirmation.
If the ordered product is not available because our suppliers do not deliver this product to us through no fault of our own, we may withdraw from the contract. In this case, we will inform you immediately and, if necessary, suggest the delivery of a comparable product. If no comparable product is available or you do not want a comparable product to be delivered, we will immediately reimburse you for any consideration already provided.
payment
Payment can be made either in advance, by credit card, purchase on account or PayPal. If you choose to pay in advance, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment. If you choose to pay on account, a risk and creditworthiness assessment (scoring procedure) is necessary due to our legitimate interest in protecting against payment default.
retention of title
The goods remain our property until full payment has been made.
Extended Producer Responsibility
As part of the legal obligation of Extended Producer Responsibility (EPR), we contribute to the management of the end of life of products. In this way, we pay an eco-contribution to the various organizations that finance waste collection, sorting, recycling and recovery.

Youth Protection Act
In accordance with the Youth Protection Act, we only supply alcoholic products to persons aged 18 and over. We reserve the right to check each case. By ordering alcoholic products on the basis of our terms and conditions, you declare that you are of legal age and have full legal capacity. By submitting the order, you confirm that you are over 18 years old and that all age, name and address details are correct. As a customer, you are obliged to ensure that only you or an adult person authorized by you can accept the delivery of the goods. If minors place orders by providing false information and/or without the permission of their adult guardian or representative, American Heritage hereby revokes these contracts as a precautionary measure in accordance with Section 111 of the German Civil Code.
warranty
We are liable for material defects in accordance with the statutory provisions.
choice of law
The contracting parties agree that German law applies to their contractual relationship.
